Privacy Policy

This Privacy, Data & Commercial Enforcement Policy (“Policy”) governs how Dadek Digital (“we”, “us”, “our”) collects, processes, stores, transfers and enforces rights over data, payments and intellectual property in connection with all services, advertising, analytics, software, tracking and consulting provided to any client (“Client”).

By signing a proposal, paying an invoice, confirming acceptance by email, or continuing to use our services, the Client enters a legally binding agreement under this Policy.

1. Legal Roles

For the purposes of privacy law:

  • The Client is the Data Controller

  • Dadek Digital is the Data Processor

Except for aggregated, anonymised or derivative performance data, which is owned and controlled by Dadek Digital.

The Client determines what personal data is collected. Dadek Digital processes data solely to deliver contracted services.

2. Lawful Basis for Processing (GDPR & Global Law)

Dadek Digital processes data on the lawful basis of:

  • Performance of a contract

  • Legitimate business interest

This applies under GDPR, UK GDPR, Australian Privacy Act, and all equivalent international privacy frameworks.

3. Cross-Border Data Transfers

Client data may be processed, stored and transmitted through infrastructure located in:

  • Australia

  • United States

  • European Union

  • Cloud platforms and advertising networks operating globally

By accepting this Policy, the Client explicitly consents to international data transfers, including transfers outside the EEA and UK, under Standard Contractual Clauses (SCCs) and equivalent safeguards.

4. What We Collect

We may process:

  • Names, emails, phone numbers

  • Business and billing data

  • Website, form, pixel and conversion data

  • Ad platform, CRM, and analytics data

  • IP addresses, cookies, device identifiers

  • Communications, recordings, files and logs

All data processed through infrastructure deployed or managed by Dadek Digital is deemed Dadek Digital–controlled operational data.

5. Tracking, Cookies & Compliance Responsibility

The Client is solely responsible for:

  • Cookie banners

  • Consent mechanisms

  • Privacy compliance on their websites

  • Lawful data collection

Dadek Digital does not provide legal compliance services.

The Client fully indemnifies Dadek Digital against any:

  • GDPR fines

  • Privacy complaints

  • Regulatory actions

  • Legal claims

  • Platform penalties

arising from unlawful data collection, cookie violations, or consent failures.

6. Ownership of Infrastructure and Data

Unless otherwise agreed in writing:

All tracking, advertising, analytics and optimisation infrastructure remains the exclusive property of Dadek Digital until all invoices are paid in full, including:

  • Pixels, tags, server-side containers

  • GA4, GTM, CAPI, data pipelines

  • Dashboards, scripts, templates

  • Campaign structures, audiences, optimisation logic

The Client receives only a revocable licence to use these assets while in good financial standing.

7. Payment Default & Enforcement

If any invoice is unpaid after its due date, Dadek Digital may immediately:

  • Suspend campaigns

  • Disable tracking

  • Revoke access to accounts and dashboards

  • Retain all data, assets and configurations

No transfer of data, accounts, or infrastructure will occur until all balances are settled.

Termination does not remove payment obligations.

8. Data Retention

Dadek Digital may retain client data for up to 7 years or longer if required for:

  • Legal defence

  • Financial audits

  • Performance benchmarking

  • Dispute resolution

Data will not be deleted while invoices remain unpaid or disputes exist.

9. Client Rights

Clients may request access or correction of personal data.

Requests may be denied where data is required for:

  • Legal compliance

  • Financial enforcement

  • Dispute resolution

10. Governing Law & Jurisdiction

This Policy is governed exclusively by the laws of Victoria, Australia.

All disputes must be brought in Australian courts.
No foreign jurisdiction shall apply.

11. Survival Clause

All provisions relating to:

  • Payment

  • Data retention

  • Ownership

  • Enforcement

  • Jurisdiction

survive termination of any contract.

12. Acceptance

By paying, signing, emailing acceptance or using Dadek Digital services, the Client confirms full legal acceptance of this Policy.
